The Supreme Court of Canada has declined to hear the Wolastoqey appeal from New Brunswick, leaving in place a decision that Aboriginal title could not be declared over privately owned, fee-simple land in that case.
This may shape the broader conversation around the Cowichan case here in B.C. — but it does not automatically settle the issue for us.
My view: homeowners deserve clarity, reconciliation deserves respect, and our market needs legal certainty so buyers, sellers, lenders, and families can move forward with confidence.
